FINRA ARBITRATION SUCCESS — In FINRA Arbitration Case Number 11-04763, Paul Dalton won a six-figure arbitration award against a national broker on behalf of the estate and beneficiaries of a deceased customer.  The customer had purchased an annuity that was supposed to have included a “guarantee of principal” death benefit feature, but — as actually delivered — the annuity did not include that feature.  Consequently, when the customer died, the amount paid to the beneficiaries was only the then-current market value of the annuity, which was substantially less than the principal amount paid for the annuity.

The arbitration award required the broker to pay to the claimants (1) damages making up the difference between the market value and the principal amount of the annuity and (2) claimants’ attorney’s fees incurred in pursuing their claims.
